Terms and conditions
These terms govern the use of this website and the legal relationship between Whitesides GmbH and users.
Note on applicability
These terms primarily apply to direct sales to consumers via our individual book websites (Der KI-Coach, The AI Coach, KI-Hero, Kreativ, echt, sichtbar.). The publisher site whitesides-publishing.com itself does not sell books directly to consumers but refers them to the book websites or the book trade.
The publisher site nevertheless requires terms templates for:
- Manuscript submissions (agreement between submitter and publisher)
- Trade direct orders (B2B conditions)
- Newsletter subscription (terms of use)
1. Scope
These terms apply to the use of the website www.whitesides-publishing.com and to all contracts between Whitesides GmbH (the "Publisher") and users of this website (the "Users").
Direct sales of individual titles via the respective book websites are governed by separate terms.
2. Manuscript submissions
By submitting a manuscript, the User represents that they hold all rights in the submitted work and that no third-party rights are infringed.
The Publisher undertakes to treat the manuscript confidentially. Acceptance occurs through a separate publishing contract that governs the assignment of rights.
The Publisher accepts no liability for the loss of or damage to submitted manuscripts. Physical manuscripts will not be returned. Digital submissions are deleted after eight weeks if rejected.
3. Trade conditions
Orders from the book trade are governed by the conditions published on the Booksellers page. Volume discounts apply from the thresholds stated there.
Delivery is handled by Books on Demand, Norderstedt. Delivery times and shipping costs follow BoD's conditions.
4. Newsletter
Newsletter subscription is via double opt-in. You can unsubscribe at any time using the unsubscribe link in every newsletter email.
5. Liability
The Publisher is liable for damages caused by intentional or grossly negligent conduct. Otherwise, liability is limited to the foreseeable, typical damage.
6. Applicable law and place of jurisdiction
German law applies, excluding the UN Sales Convention. The place of jurisdiction for disputes with merchants is Berlin.
7. Final provisions
Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision.
